Terms & Conditions

These Terms and Conditions govern the provision of services by Beyond Web Solutions and apply to all clients who engage our services through a signed quotation, agreement, or service order.

By accepting a quotation, engaging our services, or proceeding with a project, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.

Definitions

For these Terms and Conditions:

• “Product” refers to the website, web application, mobile application, or other digital solution developed or delivered by Beyond Web Solutions.
• We refer to Beyond Web Solutions.
• Client refers to the individual, company, or organization engaging our services.

Quotation Validity

All quotations issued by Beyond Web Solutions remain valid for thirty (30) days from the date of issue unless otherwise stated.

After the validity period expires, pricing, timelines, and scope may be revised at our discretion.

Payment Terms

Unless otherwise agreed in writing, payment shall be made according to the following schedule:

The initial payment serves as a project commencement deposit and is non-refundable.

Development work will only begin after the first payment has been received and cleared.

Failure to make payments on time may result in project suspension until outstanding balances have been settled.

Client Responsibilities

To ensure timely project completion, the client agrees to:

• Provide all required content, images, branding materials, and other resources necessary for the project.
• Review submitted work and provide feedback within a reasonable timeframe.
• Designate an authorized representative to communicate project decisions.
• Ensure that all provided content complies with applicable laws and does not infringe upon third-party rights.

Delays caused by the client may affect the agreed project timeline and delivery schedule.

Project Commencement and Timeline

The project will commence upon receipt of the initial deposit and all necessary project requirements.

Unless otherwise agreed in writing, the total project duration shall not exceed four (4) months from the date of the first invoice.

If delays occur due to the client’s failure to provide content, approvals, feedback, or required information, we reserve the right to revise timelines accordingly.

Scope of Work

The services provided shall be limited to the scope described in the approved quotation or proposal.

Any additions, modifications, enhancements, or changes requested after project commencement shall be considered out-of-scope work.

Where additional work is requested:

• We will provide an estimate of additional costs and timelines.
• Written approval from the client will be required before implementation begins.
• Additional charges may apply based on the complexity and extent of the requested changes.

Product Approval and Launch

Before launch, the client shall review the completed product and provide final approval.

Upon approval and launch:

• The project shall be considered completed.
• Any further changes, updates, modifications, or enhancements requested by the client may be treated as separate tasks and billed accordingly.
• We shall not be responsible for issues resulting from client modifications made after launch.

Project Termination

If the client chooses to terminate the project after acceptance of the quotation or after work has commenced:

• The initial deposit shall remain non-refundable.
• We reserve the right to invoice the client for all work completed up to the termination date.
• Any outstanding balances shall become immediately payable.

Termination does not affect any rights or obligations that accrued before termination.

Intellectual Property and Content Ownership

The client warrants that all content, images, trademarks, logos, and materials provided for the project are legally owned or properly licensed.

The client shall indemnify and hold us harmless from any claims arising from unauthorized use of such materials.

Ownership of the final product shall transfer to the client upon full payment of all invoices, except for any third-party components, licensed software, frameworks, or proprietary tools used during development.

Prohibited Use

The client agrees not to use the product for:

• Any unlawful purpose.
• Activities that violate Singapore laws or regulations.
• Copyright infringement or intellectual property violations.
• Distribution of malicious software or harmful content.
• Fraudulent, deceptive, or unauthorized activities.

We reserve the right to refuse services or terminate agreements where illegal or unethical activities are suspected.

Warranty of Service

We provide a warranty period of six (6) months from the date of product delivery.

During this warranty period:

• Bugs and errors directly related to the implemented scope of work will be rectified at no additional cost.
• Requests for new features, enhancements, redesigns, integrations, or functionality changes are not covered under warranty.
• Issues arising from third-party software changes, hosting environments, or client modifications may incur additional charges.

Exclusions

The following services are not included unless specifically stated in the quotation:

• Purchase of stock images, videos, or media requiring royalty payments.
• Third-party software licenses.
• Domain registration fees.
• Hosting fees.
• Ongoing maintenance services beyond the warranty period.
• Additional training or consultation services.

Limitation of Liability

To the fullest extent permitted by law, Beyond Web Solutions shall not be liable for:

• Loss of profits.
• Loss of business opportunities.
• Loss of data.
• Indirect, incidental, consequential, or special damages arising from the use of the product or services.

The client acknowledges that use of the product is at their sole risk.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore.

Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Singapore.
